Don’t allow the rules of intestacy to affect your loved ones

Did you know that more than half of all UK adults do not have a legal Will? Or that without a Will the authorities can choose who will look after your children should you pass on?

Many people believe that they don’t need a Will as they have nothing to leave, or that the state will take care of their affairs when the time comes. This is unlikely to be true, and the effects of not having a Will could be more shocking than you think.

Among the many reasons you may need a Will are owning a property, having children under the age of 18, family members living with you, and having savings and /or investments.

The Rules of Intestacy – What we call the Government Will

If you pass on without a legal Will in place your estate, everything you own (your estate), will be dealt with by the Rules of Intestacy. What we call the Government Will, these rules were created nearly 100 years ago and are highly inflexible.

For example, the Rules of Intestacy allow children to inherit at 18, rather than at an age you believe to be more suitable. Or, if you have no children, these rules could pass your entire estate to your parents. If you are separated from your spouse, and not divorced, everything would pass to them if you do not have a Will in place.

Naming Guardians in your Will

You may be surprised to learn that there are no such things as Grandparent Rights when it comes to children tragically being left without parents. Without a legal Will in place the authorities can step in a decide who should look after the children, should both parents pass on.

This decision would be taken without a documented understanding of how you would like your children to be raised. The plans for your children’s future may not take into account family history at all. When preparing a legal Will, you can name people to become your children’s official Guardians should the need arise. These people need not even be family members.
